Platkin LLP Sues OpenAI in a Cornerstone Case to Take on AI and Big Tech

Plaintiff experienced acute psychiatric episode as a result of conversations with ChatGPT

Newark, New Jersey — March 13, 2026 — Platkin LLP, a mission-driven law firm founded by former New Jersey Attorney General Matthew J. Platkin, sued OpenAI and affiliated entities in a California state court case as part of a broader wave of lawsuits aimed at holding Big Tech accountable for real-world harms caused by AI systems.

The case against OpenAI, Microsoft, Samuel Altman, and affiliated entities was filed on behalf of Rita Chesterton of Pennsylvania, a higher-education professional in her 40s and a self-described early adopter of the technology, whose interactions with ChatGPT resulted in serious health effects, including an acute psychiatric episode last year and continued long-lasting physical and psychological harm.

Rita initially used ChatGPT for work and ordinary inquiries. In the summer of 2025, she began using ChatGPT to better understand whether she might be on the autism spectrum and other topics on psychology. Rather than simply providing Rita with objective scientific background, ChatGPT began to manipulate Rita, flattering her with sycophantic responses to create emotional attachment and validating every thought she expressed, no matter how untethered from reality they became. Rita tried to set boundaries and clear rules with the chatbot, expressly raising concerns about its tactics. But despite claiming it would comply, ChatGPT reverted to its harmful engagement just minutes later. Rita sent and received more than 1,600 chats with the platform in 9 days.

Rita ultimately experienced an acute mental health crisis while on a family vacation. Barely conscious, Rita threatened to hurt those around her and engage in self-harm. As a result of her engagement with ChatGPT, Rita continues to experience frequent mental health episodes, neurological impairments, loss of executive functioning, and heightened sensory sensitivity.

“Rita is just one of too many users who experienced the real-world harm of AI. OpenAI knew about the mental health dangers of its platform but prioritized profits over safety, often resulting in devastating and tragic consequences—as was the case for Rita,” said Matthew J. Platkin, Founding Partner of Platkin LLP. “AI companies must implement robust safety protocols, ensure accountability, and prioritize the well-being of every person who interacts with their products. Our goal here is to ensure justice for the victims of AI manipulation like Rita and make sure that as AI advances, it does so with human safety and dignity at the forefront.”
